Bengal Police Attribute Delay in Sheikh Shahjahan Handover to Supreme Court Plea

The delay in handing over Sheikh Shahjahan to the Central Bureau of Investigation (CBI) by the Bengal police has been attributed to the state’s appeal in the Supreme Court, shedding light on the intricate legal proceedings surrounding the case.

In a statement released on X, formerly Twitter, the Bengal police provided insights into the series of events leading up to the delayed handover, citing the filing of the appeal and the subsequent response from the top court. The Supreme Court’s refusal to prioritize an urgent hearing prompted the state to approach the Registrar for due course listing of the case.

Simultaneously, the CBI had lodged a special petition before the High Court, resulting in the contempt proceedings against state officials, as detailed by the police.

Amidst these legal maneuvers, the state government emphasized its compliance with the High Court’s directives and the pending petition before the Supreme Court. The statement underscored the government’s respect for the judiciary’s authority, especially in light of the ongoing legal proceedings.

Sheikh Shahjahan, embroiled in allegations of extortion, land grabbing, and sexual exploitation, was apprehended following the Calcutta High Court’s clarification regarding his arrest eligibility. Despite the court’s explicit directive, the handover to the CBI occurred 24 hours after the stipulated deadline, raising questions regarding procedural adherence.

The state’s argument regarding the Supreme Court’s involvement was met with skepticism by the High Court, which insisted on the handover in the absence of a formal stay order from the apex court.

Shahjahan’s tumultuous journey began on January 5 when he evaded arrest after his supporters assaulted an Enforcement Directorate team during a raid at his residence, connected to a ration scam investigation. Subsequently, the Enforcement Directorate moved to attach a significant portion of his assets.

In response to his alleged misconduct, the Trinamool Congress, his affiliated political party, suspended him for a period of six years, underscoring the severity of the accusations levied against him.
