    Supreme Court Directs K Kavitha to Seek Bail from Lower Court

    In a recent development, the Supreme Court has directed BRS leader K Kavitha, who was arrested in the Delhi liquor policy case by the Enforcement Directorate (ED), to approach the trial court for bail. The court emphasized that individuals, including politicians, cannot bypass the established legal procedures by directly approaching the top court for bail.

    K Kavitha, daughter of former Telangana Chief Minister K Chandrashekhar Rao (KCR), was arrested from her Hyderabad residence last week and subsequently brought to Delhi. The Supreme Court’s decision to redirect her bail plea to the lower court underscores the need for a uniform policy in legal matters.

    A special bench comprising Justices Sanjiv Khanna, MM Sundresh, and Bela Trivedi highlighted that the top court cannot entertain bail applications solely based on an individual’s political status or financial capability to approach the apex court directly. The directive comes in the context of maintaining the integrity of legal processes and ensuring fairness in the judicial system.

    The Supreme Court’s order mandates that once K Kavitha files her bail petition in the trial court, it must be expedited for prompt consideration. Additionally, the court issued a notice to the Enforcement Directorate regarding the provisions of the money laundering law invoked in Kavitha’s arrest.

    The hearing regarding Kavitha’s writ petition took place amid heightened scrutiny following the arrest of Delhi Chief Minister Arvind Kejriwal in the same case. Kejriwal’s arrest has sparked widespread debate and legal discussions regarding the alleged conspiracy and corruption related to the Delhi excise policy.

    Notably, Kejriwal’s arrest marks the third instance of a high-profile leader from the Aam Aadmi Party (AAP) being apprehended in connection with the aforementioned case. The ED has accused Kavitha and others of conspiring with top AAP leaders, including Kejriwal and his former deputy Manish Sisodia, to illicitly benefit from the now-voided Delhi excise policy.
